Terms & Conditions

1. The contract between us
We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

2. Our right to refuse your order
2.1 We reserve the right to refuse to accept your order for any reason including, without limitation and whether or not payment has been received by us, if:
2.1.1 We have insufficient stock to deliver the goods you have ordered;
2.1.2 We do not deliver to your area; or
2.1.3 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
2.2 If we do refuse your order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

3. Price
3.1 The prices payable for goods that you order are as set out in our website.
3.2 You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website.
3.3 All orders are processed in GBP at the prices displayed at time of order.

4.1 Consumer Distance Selling Regulations

Consumer distance selling regulations means that if for any reason you are unhappy with your purchase, you can return it to us in its original condition within 7 days of the date you received the item, and we will issue a full refund for the price you paid for the item less any carriage costs. Please note that all items returned must be unused and in pristine condition. A 25% charge will be made against goods returned that do not meet this criteria.

Bespoke and custom made items are excluded as they are made specifically to customer’s orders. This does not include goods that are faulty. If the cover is found to be faulty within one month of delivery the cover may be returned for a full refund, replacement or repair. After one month the cover will either be repaired or replaced, any refunds after this time will take usage into consideration. This does not affect your statutory rights.

With the exception of faulty or damaged goods it is the customer’s responsibility to return goods to us. Where goods are faulty or incorrect we can arrange for our courier to collect items. We are unable to exchange items that are not damaged, defective or incorrect if the item is outside the 7 days (this will not however affect your 12 month guarantee if the item has broken due to a manufacturing fault). Please note that this does not affect your statutory rights.

Returns (excluding custom made products)

If you have received the wrong item, the items is faulty, or if the item has been damaged in transit, please contact us immediately (within 7 days) and we will arrange for it to be returned at our cost. We may ask you to post the item in which case we request that you obtain proof of postage and the cost will be refunded to you.

If you have changed your mind, under the Consumer Distance Selling regulations, you have 7 days to inform us of this and to return the goods at your own cost. If you are returning your good(s) please inform us that you would like to return the item either by phone or email and send the good back to us. Please note that the responsibility of return lies with the customer as no refund or replacement can be issued until the goods are received in our office.

Important – Please note that all goods that are returned in exchange for a new item or refund must be in immaculate condition and sent with appropriate paper work.  For all goods that are not returned in suitable packaging in  immaculate condition a 25% charge will be made.  For all returns sent without appropriate paperwork may lead to a delay in processing your return and may take up to 6 weeks to process.

Custom Made Products

Please note that as these products are made to order they cannot be cancelled once the order has been placed or altered once work has begun. On receipt of your order an order confirmation or invoice will be sent by post detailing your order. Please check this carefully as alterations cannot be made once work has begun on the cover. Colour swatches are available on request.

Privacy & Liability

We will treat all of your information as confidential and we will not pass on any of your details to any third party.

We have taken steps to ensure that all information we hold is stored in a safe and secure way. We operate a safe and secure website and have taken steps to make sure that shopping on our website is protected. All information stored both on our server and in hardcopy format is stored as securely and safely as possible. However we cannot be held liable in the unlikely event of a breach in our secure computer server.

Your Statutory Rights

At Prestige Car Covers Ltd we want you to be delighted every time you shop with us. Occasionally though, we know you may want to return items. If this is the case please refer to the returns procedure above and the Consumer Distance selling regulations.

Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective. If we do not receive the item back from you with the delivery slip, we may arrange for collection of the item from your residence at your cost.

You should be aware that once we begin the delivery process you will not be able to cancel any contract you have with us for additional services carried out by us

As soon as we receive notice of your cancellation of this order, we will refund the relevant part of the purchase price for that item together with the item's normal postage charge--we cannot refund any priority, express or courier component of the postage charge. For more information on your right to withdraw from your purchase within the seven working days cooling-off period, visit the Department of Trade and Industry's website at: http://www.dti.gov.uk

5. Delivery of goods to you
5.1 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.
5.2 Delivery will be made as soon as possible after your order is accepted in line with our stated delivery timescales.
5.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

6. Fraud prevention
6.1 You agree that we may use Personal information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.
6.2 We will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

7. Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at Classic and Performance Car Covers, C/O Regus Business Centre, Kingsway North, Team Valley, Tyne and Wear, NE11 0NQ

All notices from us to you will be displayed on our website from to time.

7.1 Returned Goods Address:

We will furnish you with the appropriate return address to send us goods back, should they be deemed unacceptable for whatever reason. Once this has been agreed between ourselves and yourself, we will tell you where to send the goods back to. Please do NOT under any circumstances send goods back to us without prior agreement.

8. Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

9. Governing Law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

10. Entire agreement
These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us and except where you are dealing as a consumer:
10.1 Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us; and,
10.2 Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
